FanCam AI Terms of Use

These Terms of Use ("Terms") govern your access to and use of:

the FanCam AI: Fan Cam Video Maker app for iOS, distributed through the Apple App Store;
the FanCam AI: Fan Cam Video Maker app for Android, distributed through Google Play; and
the website https://fancamai.app

(together, the "Service"). The Service is provided by the developer of the FanCam AI apps, who is named as the seller on the App Store listing and as the developer on the Google Play listing ("FanCam AI", "we", "us" or "our").

By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of the Service

FanCam AI lets you create short, AI-generated, stadium-style "fan cam" videos. You choose one photo and enter match details (the sport, home and away team names, score and game minute) and pick a prop and a resolution. Our server sends your photo and AI instructions built from your selections to a third-party AI provider, which creates a still image and then a short video clip with AI-generated sound. The app adds a scoreboard to the video on your device.

The videos are synthetic and fictional. Teams, scores and scenes are AI-generated and do not show real events.

The website provides information about the apps and links to the app stores.

The Service relies on third-party cloud, AI processing, notification, purchase and app store providers to operate (see Section 11).

2. Eligibility

You must be at least 18 years old to use the Service.

You must not use the Service if you are prohibited from doing so under applicable law.

The apps do not let you create an account, sign up or log in. When you first open an app, it creates a random anonymous ID. Your credits, uploads and videos are linked to this anonymous ID.

We do not offer a way to move an anonymous ID, or its credits, to another device.
You can delete the anonymous ID and its data at any time in the app under Settings → Delete Account & Data.
On Android, the app does not allow backups, so uninstalling the app or clearing its data removes the anonymous ID from your device. We may not be able to restore your credits or videos afterwards.

4. Your content

"User Content" means any photo, image, face, likeness, text (including team names and match details), report or other material you upload, enter or submit through the Service, and the AI-generated images and videos you create with it.

You keep ownership of your User Content. We do not claim ownership of it.

You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, upload, transmit, reproduce, modify, process, transform, store and display your User Content only as necessary to operate, secure, support and provide the Service. This includes sharing your photo and the AI instructions with our AI processing provider to create the videos you request. This licence ends when your User Content is deleted from our systems, as described in our Privacy Policy.

We do not use your User Content to train AI models of our own.

You are solely responsible for all User Content and AI-generated outputs that you create, upload, save, publish, share or distribute.

By using the Service, you confirm that:

you own or have all rights, licences, permissions and consents needed for every photo and other content you upload or enter;
you have the consent of every person whose face or likeness appears in a photo you upload;
you will upload a photo of a minor only if you are their parent or legal guardian or have their parent's or guardian's permission;
you are responsible for the team names, club names, trademarks and other text you enter;
your use of the Service will not violate any law, regulation, contract, privacy right, publicity right, copyright, trademark or other third-party right; and
you will not use the Service in a deceptive, harmful, abusive, illegal or non-consensual way.

Before your first video, the app asks you to confirm that you have the right to use the photo and that you consent to it being processed as described. You must not give that confirmation unless it is true.

6. Prohibited uses

You may not use the Service to create, upload, generate, distribute or assist with:

illegal, harmful, abusive, fraudulent, defamatory, harassing or deceptive content;
non-consensual use of another person's face, likeness, identity or personal attributes;
harmful, misleading or deceptive synthetic media or deepfake-style content;
impersonation of any real person in a way that is deceptive, unlawful, harmful or non-consensual;
intimate contact, kissing, romantic or sexual scenes;
nudity, or sexual, intimate or exploitative content of any kind, including non-consensual intimate content;
any sexual, exploitative, abusive or unsafe content involving minors;
threats, bullying, stalking, hate, discrimination or targeted harassment;
fraud, scams, blackmail, extortion, identity theft or phishing;
political deception, fake endorsements, election misinformation or misleading public-interest content;
presenting outputs as real footage of a real event, or removing or hiding the "Made with AI" label or description we add to outputs (such as the description on videos saved from the Android app). Turning off the optional FanCam watermark in Settings is allowed;
content that infringes copyright, trademark, publicity, privacy or other legal rights;
malware, automated abuse, scraping, reverse engineering, bypassing payments, credit or access controls, or interfering with the security of the Service; or
any use that violates applicable law, App Store or Google Play rules, or the terms of our third-party providers.

7. AI-generated content

Outputs are synthetic and fictional. They do not show real events, and they are not real footage of you or anyone else.
Your photo is processed by a third-party AI provider to create the outputs, as described in our Privacy Policy.
AI-generated outputs, including their sound, may be inaccurate, unrealistic, unexpected, offensive, incomplete or unsuitable for your intended use. They may not look like the person in the photo.
Generating a video can take a few minutes, and sometimes longer. We do not promise any particular speed.
We do not guarantee that any output will meet your expectations, be accurate, be unique, be legally safe to use, or be free from third-party claims.
You are responsible for reviewing outputs before you save, share, publish or use them.
You are responsible for complying with any law or platform rule that requires disclosure, labelling, consent or restrictions for synthetic media, AI-generated content, manipulated media or content using a person's face or likeness.
FanCam AI is not affiliated with, sponsored by or endorsed by any team, club, league, athlete, stadium or broadcaster. The team names on the scoreboard come from what you entered. The AI may still produce logos, crests, kits, text or other elements that look like those of real teams or brands. This does not mean any affiliation or endorsement, and you are responsible for how you use such outputs.

8. Reporting and enforcement

Reporting. In the Android app, you can report a result with "Report this result". On iOS, on the website, or for any other concern, email support@fancamai.app.

Enforcement. Where technically and legally possible, we may:

suspend, restrict or terminate access to the Service if we believe you violated these Terms or used the Service unlawfully or harmfully; and
remove, block, preserve, disclose or report content or related data if the law requires it or if it is necessary to protect users, third parties, the Service or the public.

We are not obligated to monitor all User Content, but we may take action when abuse, violations or legal risks are detected or reported.

To the fullest extent permitted by law, FanCam AI is not responsible or liable for illegal, unauthorised, deceptive, harmful or non-consensual use of the Service by users. Any misuse of the Service is your sole responsibility.

9. Credits, purchases and refunds

Credits. Creating a video uses credits. The number of credits a video uses depends on the resolution you choose. Credits are sold in packs as consumable in-app purchases. The apps do not sell subscriptions.

Payment. Purchases are made and paid for through Apple In-App Purchase on iOS or Google Play Billing on Android. RevenueCat manages the purchase records for us. We never receive your payment card details. Prices are shown in the app store at the time of purchase and may change.

How credits work:

Credits are used up when you spend them on a video.
Credits do not expire.
Credits have no cash value, cannot be exchanged for money and cannot be transferred, sold or gifted.
Credits are linked to your anonymous ID (see Section 3).
Credits are lost when you use Delete Account & Data. On Android, they are also lost if you uninstall the app or clear its data.
If a video generation fails, the credits used for it are returned to your balance automatically.
We may limit how many videos can be generated per day.

Refunds:

App Store purchases are refunded by Apple under Apple's policies. You can request a refund from Apple at https://reportaproblem.apple.com.
Google Play purchases are subject to Google Play's refund policies (https://support.google.com/googleplay/answer/2479637). You can request a refund through Google Play, and you can also contact us at support@fancamai.app about a Google Play purchase.
If Apple or Google refunds a purchase, we remove the credits from that purchase from your balance, up to the number of credits you have left.
Except as described above or as required by applicable law, purchases are non-refundable.

You may not attempt to bypass, manipulate, exploit or interfere with payment, credit or access systems.

10. Review access codes

Some versions of the app include a field for a private review access code. These codes are intended only for app store review teams.

A code can be redeemed once per anonymous ID.
We may cap, rotate or revoke codes at any time.
Codes and the credits they grant have no cash value.
You may not share, publish or sell a code.

11. Third-party services

The Service relies on third-party services, including:

Google Firebase and Google Cloud (sign-in, database, storage, cloud functions, notifications, app integrity);
Replicate (AI image and video processing);
RevenueCat (purchase records);
Apple App Store and Google Play (app distribution and payments);
Cloudflare (website hosting and page-view counting, and routing of email sent to support@fancamai.app); and
Google Analytics (website analytics, only with your consent).

Your use of the Service may also be subject to these providers' terms and privacy policies.

We are not responsible for third-party services, outages, errors, policies, data practices, moderation decisions, processing delays or failed generations.

12. Privacy

Your use of the Service is also governed by our Privacy Policy at https://fancamai.app/privacy/, which explains what data we collect, how we use it, how long we keep it and how to delete it.

13. Service availability

We may modify, suspend, limit, discontinue or replace any part of the Service at any time.

We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with every device or region.

AI generation may fail, take longer than expected or produce unusable results because of third-party services, network issues, moderation systems, processing errors, queue delays or technical limitations.

14. Intellectual property

The Service, including its design, software, branding, interface, features, code, trademarks and other materials, is owned by or licensed to FanCam AI. These Terms do not affect your ownership of your User Content (see Section 4).

You may not copy, modify, distribute, sell, reverse engineer, scrape, decompile or create derivative works from the Service, except where the law allows.

15. Limited licence

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for lawful personal or internal creative purposes, subject to these Terms.

This licence does not give you ownership of the Service or any related intellectual property.

16. Disclaimer of warranties

The Service is provided "AS IS" and "AS AVAILABLE".

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement and uninterrupted operation.

We do not warrant that outputs will be safe, lawful, accurate, unique, usable, suitable for commercial use, or free from claims by third parties.

17. Limitation of liability

To the fullest extent permitted by law, FanCam AI will not be liable for any indirect, incidental, special, consequential, exemplary, punitive or similar damages, including loss of data, loss of profits, loss of reputation, business interruption, or claims arising from your use or misuse of the Service.

To the fullest extent permitted by law, our total liability for any claim related to the Service will not exceed the greater of (a) the amount you paid for the Service during the three months before the claim arose and (b) USD $50.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited, or any rights you have under mandatory consumer protection law.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify and hold harmless FanCam AI from and against any claims, damages, losses, liabilities, costs, expenses or legal fees arising from:

your User Content;
your AI-generated outputs;
your use or misuse of the Service;
your violation of these Terms;
your violation of any law or third-party right;
your failure to obtain required rights, permissions, licences or consents; or
your sharing, publishing or distribution of generated content.

19. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, misuse the Service, create legal risk, or use the Service in a harmful or unlawful way.

You may stop using the Service at any time. To delete your anonymous ID and its data, use Settings → Delete Account & Data in the app before uninstalling it. Unused credits are lost when you do this.

Sections that by their nature should survive termination continue to apply, including those on User Content, your responsibilities, prohibited uses, AI-generated content, disclaimers, limitation of liability, indemnification, and governing law and disputes.

20. Apple App Store

If you downloaded the iOS app from the Apple App Store, the following also applies:

Parties. These Terms are between you and FanCam AI only, not Apple. FanCam AI, not Apple, is solely responsible for the app and its content.
Licence. Your licence to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Your use of the app is also subject to Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/); these Terms add to it.
Maintenance and support. FanCam AI is solely responsible for any maintenance and support of the app. Apple has no obligation to provide maintenance or support.
Warranty. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
Product claims. FanCam AI, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
Intellectual property. If a third party claims that the app or your possession and use of it infringes that third party's intellectual property rights, FanCam AI, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
Third-party terms. You must comply with applicable third-party terms when using the app.
Contact. Questions, complaints or claims about the app should be sent to support@fancamai.app.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

21. Google Play

If you downloaded the Android app from Google Play:

These Terms are between you and FanCam AI only. Google is not a party to these Terms and is not responsible for the app or its content.
Your use of Google Play, including purchases made through Google Play Billing, is also subject to the Google Play Terms of Service (https://play.google.com/about/play-terms/) and Google's policies.

22. Governing law and disputes

These Terms are governed by the laws of the country where FanCam AI's developer (named as the seller on the App Store and as the developer on Google Play) is established or resident, without regard to conflict-of-law principles.

If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live, and you may also bring proceedings in the courts there.

23. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated Terms at https://fancamai.app/terms/ and change the "Last updated" date above. Continued use of the Service after a change takes effect means you accept the updated Terms.
